IANAL and I won't get into the nitty gritty of it, but every case in which the government does this, they basically tank their case. When you prosecute someone, you have to shut up and not do anything to endanger your case.
So why do it? When it's a guaranteed loss?
Because they aren't expecting to get convictions. Only to intimidate people. Look at how they deport people illegally. They don't care about the legal process.
The White House posted a manipulated photo of Nekima Levy Armstrong, a Minnesota civil rights attorney arrested for protesting in a church, to make it appear she was crying. This action has been criticized as outrageous defamation by her attorney, Jordan Kushner. The NAACP has called for the release of Levy Armstrong and others arrested during the protest. The manipulated photo could be used in Levy Armstrong’s legal defense.
